TERMS OF USE

Updated as of September 16, 2026

KodeDice LLC, a Delaware limited liability company, together with its officers, directors, employees, contractors and affiliates (collectively, the “Company,” “we,” “us,” or “our”), operates FunSpinz, available at https://www.funspinz.com and through associated mobile apps and social media pages (collectively, the “Platform”). If you access the Platform through an external site, app store, or third-party platform (such as a Facebook, Instagram, or X page), you are also bound by that third party’s own terms and policies.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING, USING, OR BROWSING THE PLATFORM. ACCESSING, USING, OR PARTICIPATING IN THE PLATFORM CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF USE.

THESE TERMS OF USE FORM A BINDING AGREEMENT BETWEEN YOU AND KODEDICE LLC AND GOVERN YOUR USE OF THE PLATFORM, INCLUDING ALL GAMES OFFERED ON IT. WHILE SOME GAMES MAY RESEMBLE SLOT MACHINES OR OTHER GAMES FOUND IN REAL-WORLD CASINOS, NO GAME ON THE PLATFORM OFFERS REAL-MONEY GAMBLING. NO PURCHASE IS EVER REQUIRED TO PLAY, AND ALL SERVICES ON THE PLATFORM ARE INTENDED FOR ENTERTAINMENT PURPOSES ONLY. THE PLATFORM OFFERS TWO KINDS OF PLAY: SOCIAL GAMEPLAY USING GOLD COINS, AND SWEEPSTAKES GAMEPLAY USED TO PROMOTE THE PLATFORM (“SWEEPS PLAY”). NO PURCHASE IS NECESSARY TO ENTER OR PLAY SWEEPS PLAY.

THESE TERMS OF USE EXPRESSLY INCORPORATE, AND ARE INSEPARABLE FROM, OUR OTHER POLICIES, INCLUDING OUR PRIVACY POLICY, SWEEPSTAKES RULES, AND LEGAL NOTICES.

THE PLATFORM IS AVAILABLE ONLY TO PARTICIPANTS LOCATED IN THE UNITED STATES, EXCLUDING RESIDENTS OF AND PERSONS LOCATED IN CALIFORNIA, CONNECTICUT, DELAWARE, IDAHO, INDIANA, LOUISIANA, MAINE, MICHIGAN, MONTANA, NEVADA, NEW JERSEY, NEW YORK, TENNESSEE, UTAH, AND WASHINGTON (THE “EXCLUDED TERRITORY”). USERS LOCATED IN OKLAHOMA REMAIN ELIGIBLE ONLY UNTIL NOVEMBER 1, 2026; EFFECTIVE THAT DATE, OKLAHOMA WILL BE ADDED TO THE EXCLUDED TERRITORY. SEE OUR SWEEPSTAKES RULES FOR MORE ON ELIGIBILITY. THE COMPANY MAY CHANGE THE EXCLUDED TERRITORY AT ANY TIME WITHOUT NOTICE, AND WE WILL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM SUCH A CHANGE. PARTICIPATION IS VOID IN THE EXCLUDED TERRITORY AND WHEREVER ELSE PROHIBITED BY LAW.

Important information about binding arbitration

THESE TERMS OF USE CONTAIN A MANDATORY ARBITRATION PROVISION IN THE SECTION TITLED “DISPUTE RESOLUTION BY BINDING ARBITRATION.” YOU AND THE COMPANY AGREE TO RESOLVE DISPUTES SOLELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION, NOT IN COURT OR BEFORE A JURY, AND NOT AS PART OF ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. THESE TERMS ALSO LIMIT THE TIME YOU HAVE TO BRING A CLAIM AGAINST THE COMPANY. YOU HAVE THE RIGHT TO OPT OUT OF ARBITRATION — SEE THAT SECTION BELOW FOR INSTRUCTIONS.

The following governs your access to and use of the Platform, including our Social Gameplay and Sweeps Play offerings and all games, accounts, multimedia, comments, and other content available on or through the Platform (collectively, “Content”).

By electronically accessing the Platform, creating a User Account, or engaging in any service offered on or through the Platform, you agree that: (a) you have read and understood these Terms of Use and our Legal Notices; (b) you agree to be bound by these Terms of Use and our Sweepstakes Rules, Privacy Policy, and Legal Notices; and (c) you are at least the age of majority in your jurisdiction, and in no case under eighteen (18) years old, at the time of access or registration.

If you are not willing or able to be bound by these Terms of Use, do not access, browse, or use the Platform. We do not grant you any right or license to access, browse, or use the Platform, or any Content, unless you agree to be bound by these Terms of Use in full.

We may revise these Terms of Use at any time in our sole discretion. You are responsible for reviewing them periodically. Your continued use of the Platform after a change is posted constitutes your acceptance of the revised Terms of Use. The date of the most recent revision is posted at the top of this document.

THE PLATFORM IS INTENDED FOR AMUSEMENT AND ENTERTAINMENT ONLY. IT IS NOT A LOTTERY OR GAMBLING ACTIVITY, AND THE COMPANY DOES NOT PROVIDE PRIZES OF MONETARY VALUE EXCEPT AS SET OUT IN CONNECTION WITH SWEEPS PLAY.

1. General permissions and restrictions

We grant you permission to access and use the Platform as set forth in these Terms of Use, provided that you agree not to:

alter or modify any part of the Platform, except as expressly permitted;

access Content through any technology or means other than the webpages and applications we authorize;

use the Platform for any commercial purpose without our prior written authorization, including selling access to the Platform, using the Platform primarily to generate advertising or subscription revenue, selling advertising targeted to the Platform or its Content, or using the Platform in a manner we determine, in our sole discretion, competes with or displaces the Platform;

use or launch any automated system — including “robots,” “spiders,” or “offline readers” — that accesses the Platform, other than public search engines indexing publicly available pages; or

collect or harvest personally identifiable information from the Platform, or use our communication tools (comments, messaging, live chat, etc.) for commercial solicitation.

We otherwise expect you to comply with these Terms of Use and all applicable laws and regulations, and we reserve the right to discontinue any aspect of the Platform at any time.

It is your responsibility to ensure your participation and use of the Platform is lawful in your jurisdiction. Attempting to circumvent the Excluded Territory restriction — for example, by using a VPN or proxy, or by providing false information about your location — is a breach of these Terms of Use and may expose you to civil and, in some circumstances, criminal liability.

2. License

The Platform and its Content are, and remain, the property of the Company or its third-party providers. Except as expressly permitted in writing, your license to access, browse, and use the Platform is limited to a personal, revocable, non-exclusive, non-transferable license to (a) access and view the Platform and Content, and (b) upload and store Content for your non-commercial use. This license does not authorize you to copy, reproduce, modify, adapt, translate, distribute, transmit, download, upload, post, sell, rent, license, transfer, publicly perform or display, mirror, frame, scrape, extract, create derivative works of, reverse engineer, decompile, or disassemble any part of the Platform or its Content, whether manually or through automated means, except as we permit in writing.

3. Content ownership and use

All Content on the Platform — including games, text, software, graphics, photos, sounds, music, videos, and interactive features, and all trademarks, service marks, and logos — is owned by or licensed to the Company or its business partners and is protected by copyright and other intellectual property laws. Content is provided to you “as is” for your personal, informational use only.

You understand that the Platform may expose you to content from a variety of sources, including other users and third parties, and that the Company is not responsible for the accuracy, usefulness, or intellectual property status of such content, and is not responsible for content that is inaccurate, offensive, or objectionable.

Apple disclaimers

If you access the Platform through an iOS app, you acknowledge that this agreement is between you and the Company only, not Apple Inc. (“Apple”), and that: Apple and its subsidiaries are third-party beneficiaries of these Terms of Use and may enforce them against you; Apple has no responsibility for the Platform or its Content; to the extent required by applicable warranty law, Apple (not the Company) may be required to refund the purchase price for the app, and otherwise has no other warranty obligation; Apple is not responsible for addressing any claims relating to the Platform, including product liability, legal or regulatory compliance, or consumer protection claims; and Apple has no responsibility for investigating, defending, or resolving any third-party intellectual property infringement claim relating to the Platform.

Google disclaimers

If you access the Platform through an Android app, the same structure applies with respect to Google LLC (“Google”) in place of Apple, and your use must also comply with Google’s then-current Google Play Terms of Service.

4. Third-party websites, links, and games

The Platform may link to third-party websites we do not own or control, and we are not responsible for their content, privacy practices, or conduct. Some third-party sites may be fraudulent attempts to obtain your personal information or to offer to sell you virtual currency purportedly usable on the Platform. THE COMPANY IS THE ONLY ENTITY AUTHORIZED TO OFFER GOLD COINS OR SWEEPS COINS FOR USE ON THE PLATFORM. Any other offer is fraudulent, and virtual currency obtained through such offers will not be honored. Games displaying a third-party brand are owned by that third party, and your recourse in connection with any such game is limited to the Company.

5. Your User Account

To access certain features, you must create a User Account. You agree never to use another person’s User Account without permission, and to provide accurate, complete, and current information when registering — the name on your account must match your government-issued ID. If any information you provide is or becomes untrue, inaccurate, or incomplete, we may suspend or terminate your account, refuse further use of the Platform, and declare any prizes or virtual currency invalid.

You are solely responsible for all activity on your account and for keeping your password secure, and must notify us immediately of any unauthorized use. We are not liable for losses caused by unauthorized use of your account, but you may be liable for losses we incur as a result.

Single account. You may register only one (1) User Account, including any inactive account. If you open more than one, all accounts in your name may be suspended or closed. This includes accounts opened by relatives, associates, or others acting on your behalf.

Fraud and abuse. We may close your account and remove associated winnings if we suspect fraud or abuse, including delaying game rounds to avoid playing requirements, leaving virtual currency idle to return to it later, cycling bonus currency to redeem built-up value, or exploiting a software bug.

Dormant accounts. We may close, deactivate, or terminate a User Account we deem dormant — meaning there has been no login activity for sixty (60) consecutive days. We will attempt to warn you by email as you approach that period. If your account becomes dormant, we will remit the value of any redeemable prize balance to you as required by applicable law, and your Sweeps Coins will expire as described in our Sweepstakes Rules.

Closing your account. You may close your account at any time by contacting support@funspinz.com. Doing so forfeits any continued right to unredeemed virtual currency or prizes associated with the account. A closed account may be reopened at our discretion upon request to the same email address.

6. User IDs and passwords

By registering, you represent that you are of lawful age in your jurisdiction (and in no case under 18), are using your actual identity, and have provided true, accurate, and complete information, which you will keep updated. Usernames may not reference illegal conduct, violence, hateful conduct, harassment, private information of others, impersonation, self-harm, drug use (other than lawful references to alcohol, tobacco, or marijuana), or sexual content. We may suspend accounts that violate this rule.

You are solely responsible for the security of your User ID and password and for all activity conducted through your account, whether or not you personally undertook it, including activity resulting from your failure to log off a shared or public device.

We may deny or revoke access to the Platform at any time, in our sole discretion, with or without cause. If we close your account for a reason described in Section 15 (Suspension and termination), the consequences in that section apply; if we close it for another reason, we will make reasonable efforts to allow you to redeem prizes already in your account, but your license to any remaining virtual currency will terminate.

You may not transfer Gold Coins or Sweeps Coins between accounts, to or from another user, or to or from any third party. Attempts to do so may result in account termination.

7. Site monitoring and user content

We may, but are not obligated to, monitor areas of the Platform where users post or communicate. We do not endorse, and disclaim liability for, user-submitted content, and any views expressed by users are their own. We may disclose account information, communications, or other content if we believe in good faith that the law requires it, that disclosure is necessary to operate the Platform, or that disclosure is necessary to protect our rights or the rights of our users.

8. Publicity, submissions, and marketing communications

Except where prohibited by law, your use of the Platform is your consent to our use of your name, likeness, voice, opinions, and hometown/state for promotional purposes, worldwide, without further payment or notice. Any submission you make to the Platform, or post to our social media pages, grants us a royalty-free, irrevocable, perpetual, non-exclusive, worldwide license to use, reproduce, and incorporate it into other works, including for marketing purposes.

You consent to receive marketing communications from us by email, mail, SMS, and phone, and you may unsubscribe at any time by contacting support@funspinz.com.

9. Live chat

We may offer a Live Chat feature for communicating with support or other users. Live Chat is for recreational and social purposes only; we review and log chat communications. You may not use Live Chat to harass, threaten, or abuse others, to post unlawful, obscene, or fraudulent content, to advertise or solicit funds, to distribute malicious code, or to collude with other users regarding gameplay. We may ban you from Live Chat, suspend your account, and/or refuse to redeem prizes if you violate this section, and we may remove Live Chat from the Platform entirely.

10. Patents, copyrights, and trademarks

Our novel methodologies and business methods may be the subject of pending patent applications. The Platform and its Content are protected by copyright, and reproduction beyond what these Terms of Use permit is prohibited. All trademarks, service marks, logos, and trade names appearing on the Platform belong to the Company, its affiliates, or its licensors, except for third-party trademarks identified in our Legal Notices. We do not grant you rights to use our trademarks without written permission.

Copyright infringement notices

If you believe content on the Platform infringes your copyright, send our copyright agent a written notice, at legal@funspinz.com, containing: a signature of the person authorized to act for the copyright owner; a description of the copyrighted work claimed to be infringed; the location of the allegedly infringing material on the Platform; your contact information; a good-faith statement that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on the owner’s behalf. We may, in appropriate circumstances, disable or terminate the accounts of repeat infringers.

11. Games generally

Every game on the Platform has its own rules and odds, published in that game’s pay table once launched, and it is your responsibility to review them before playing. We may void a play, spin, or round, in whole or in part, if there is an error, misprint, or technical fault affecting the pay table, stakes, odds, or software. If there is a discrepancy between the result shown on your screen and the result recorded on our servers, the server record governs.

If we offer sports-prediction or live-dealer games, additional game-specific rules will be published in-product and are incorporated into these Terms of Use by reference.

12. Virtual currency

The Platform uses two types of virtual currency:

Gold Coins (“GC”) are used only in Social Gameplay, have no monetary value, cannot be redeemed for cash or prizes, and may be obtained for free (daily bonuses, promotional awards) or purchased with valid payment methods. Purchasing GC is the purchase of a digital good for entertainment use; it is not a deposit, and GC purchases are not refundable except at our discretion.

Sweeps Coins (“SC”) are used only in Sweeps Play, and may be redeemed for prizes once won, as described in our Sweepstakes Rules. SC are never sold; you may obtain SC only through the free methods described in the Sweepstakes Rules. NO PURCHASE IS EVER NECESSARY TO OBTAIN SC.

You are responsible for confirming the amount of virtual currency you intend to wager before each play. Virtual currency has no value outside the Platform, may not be sold, traded, or transferred for real-world value, and any attempt to do so violates these Terms of Use and will result in a ban. We may manage, regulate, or eliminate virtual currency at our sole discretion, and you have no ownership right or title in any virtual currency.

13. Purchasing Gold Coins

The payment method you use must be legally and beneficially owned by you and in your name. If your account name does not match your payment method, your account may be suspended pending resolution through support@funspinz.com. A chargeback will result in suspension and a debt owed to us for the disputed amount. We may request documentation to verify your identity and ownership of your payment method, and by agreeing to these Terms of Use you authorize us and our payment processors to retain your payment credentials to process future purchases, consistent with applicable payment-processing regulations. All GC sales are final except where we determine, in our sole discretion, that a refund is warranted.

14. Verification checks

We may conduct identity, credit, or other verification checks as required by law, by our regulators, or by our own risk controls. All prize redemption requests remain pending until verification is complete to our satisfaction. We may request documentation including government-issued photo identification, proof of address, and proof of source of funds — particularly where cumulative or single redemption requests exceed $100 in value. If you do not provide requested documentation within thirty (30) days, we may close, restrict, or suspend your account. We may use third-party service providers to conduct these checks.

15. Suspension and termination

We may suspend or close your account if we reasonably believe that you have breached these Terms of Use or our Sweepstakes Rules; hold more than one account; registered under a name that does not match your payment method or redemption destination; harassed or abused other users or our staff; became dormant under Section 6; became bankrupt or insolvent; provided false or misleading information; could not be identity-verified; attempted to mask or misrepresent your location; are under 18 or otherwise ineligible; are located in the Excluded Territory; allowed another person to use your account; coordinated play with other users to gain an unfair advantage; triggered a chargeback, claim, or payment dispute; failed our due-diligence checks or are suspected of fraud, collusion, or money laundering; or used automated tools to gain an unfair advantage, including to automate Sweepstakes Rules entries.

If we suspend or close your account for one of these reasons, you will be responsible for any resulting claims, losses, and expenses we incur, and you agree to indemnify us for them. We may withhold or recover any prizes, GC, or SC connected to the conduct described above, and may report your details to applicable regulators or law enforcement. Any breach of this section will result in forfeiture of prizes won in connection with that breach.

16. Disclaimers

THE PLATFORM AND ITS CONTENT MAY INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. WE MAY MAKE CHANGES AT ANY TIME WITHOUT NOTICE. THE PLATFORM AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THIS EXCLUSION MAY NOT FULLY APPLY TO YOU.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE PLATFORM, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OF USE OR THE PLATFORM WILL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, TO ACCESS THE PLATFORM. THIS SECTION DOES NOT LIMIT LIABILITY FOR INTENTIONAL MISCONDUCT, GROSS NEGLIGENCE, OR FRAUD, OR WHERE APPLICABLE LAW DOES NOT PERMIT SUCH A LIMITATION.

18. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and suppliers from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising from: your use of the Platform; any arrangements you make based on Content obtained through the Platform; your breach of these Terms of Use; activity on your account, whether or not undertaken by you; any attempt to circumvent these Terms of Use or our other policies; or any fraud you commit in connection with the Platform. This section survives termination of your account or these Terms of Use.

19. Force majeure

We are not liable for any failure to perform caused by events outside our reasonable control, including equipment or communications failures, cyberattacks, unauthorized access, severe weather, natural disasters, labor disputes, pandemics, war, or government action.

20. Term and termination

We may, at any time and without notice, deny you access to the Platform or discontinue any part of it. You may terminate this agreement by ceasing all use of the Platform and, upon request, certifying that you have deleted any Content you obtained from it. Provisions that by their nature should survive termination — including disclaimers, limitations of liability, and intellectual property provisions — will survive.

21. Notices

Legal notices to the Company must be in writing and delivered by certified U.S. mail, return receipt requested, to:

KodeDice LLC, Attn: Legal Department

1007 N Orange St., 4th Floor, Ste 1382

Wilmington, DE 19801

Notices to the Company are deemed given when actually received. Notices to you will be sent to the email address on your account and are deemed received the next business day. It is your responsibility to keep your email address current.

22. Governing law

Except as provided in the arbitration section below, these Terms of Use and your access to and use of the Platform are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws principles. This provision does not displace any statutory consumer protections that cannot be waived under the law of your state of residence.

23. Dispute resolution by binding arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND THE COMPANY TO ARBITRATE DISPUTES AND LIMITS THE WAYS YOU CAN SEEK RELIEF, SUBJECT TO THE OPT-OUT RIGHT BELOW. ARBITRATION MEANS YOU GIVE UP THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL. THIS SECTION ALSO PRECLUDES YOU FROM BRINGING OR PARTICIPATING IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION AGAINST THE COMPANY.

Scope. Unless you opt out under this section, you and the Company agree that any claim, dispute, or controversy between you and the Company arising out of or relating to your access to or use of the Platform or its Content will be resolved exclusively through final and binding individual arbitration, whether the claim arose before, on, or after your acceptance of these Terms of Use. This includes claims based on contract, tort, statute, or any other legal theory.

Time limit to bring a claim. Any claim arising out of or relating to your access to or use of the Platform must be filed for arbitration within one (1) year of the event giving rise to the claim, or it is permanently barred. If this time limit is unenforceable as to a particular claim, the limitations period under the applicable state or federal law governs instead.

Cost of arbitration. If your claim does not exceed $10,000, the Company will pay the filing, administrative, and arbitrator fees to the extent they exceed $200, unless the arbitrator finds your claim frivolous or brought for an improper purpose. If you demonstrate that arbitration costs would be prohibitive compared to litigation, the Company will pay as much of your filing and hearing fees as the arbitrator deems necessary to avoid that result. You remain responsible for your own attorneys’ fees.

Procedure. This section is governed by the Federal Arbitration Act and, to the extent not preempted, the Delaware Uniform Arbitration Act. The American Arbitration Association (“AAA”) will administer the arbitration under its Commercial Arbitration Rules and, where applicable, its Consumer Arbitration Rules, in effect at the time arbitration is sought (available at www.adr.org or 1-800-778-7879). The arbitrator may award any individual relief available under applicable law, but has no authority to award relief to or against anyone who is not a party to the arbitration, and no authority to award punitive or exemplary damages except as expressly authorized by statute. The arbitrator’s decision is final and binding and may be entered as a judgment in any court of competent jurisdiction. Either party may seek interim injunctive relief from a court at any time without waiving the right to compel arbitration.

The arbitrator, and not any court, has exclusive authority to resolve disputes about the interpretation, applicability, enforceability, or formation of these Terms of Use, including whether a particular claim is subject to arbitration — except that any dispute about the validity or enforceability of the class, collective, and representative action waiver in this section will be decided by a court of competent jurisdiction, not an arbitrator, and except that either party may bring a qualifying claim in small claims court in lieu of arbitration.

Pre-arbitration notice. Before starting arbitration, you must send a written notice by certified mail to KodeDice LLC, Attn: Legal Department, at the address in Section 21, describing: (a) information sufficient to identify your account; (b) a description of your claim; and (c) the relief you seek. If we do not resolve the dispute within thirty (30) days of receiving a compliant notice, you may commence arbitration.

Right to opt out. Whether to arbitrate is an important decision that you should make after your own research; this section is not a complete explanation of arbitration’s consequences. If you do not want to be bound by this arbitration agreement, you must opt out within thirty (30) days of first accepting these Terms of Use by sending written notice — by email to legal@funspinz.com, or by mail to KodeDice LLC, Attn: Legal Department, at the address in Section 21 — stating your name, your account email address, and a clear statement that you decline to arbitrate disputes with the Company. If you do not opt out within that window, you and the Company will be bound by this section.

Confidentiality. You and the Company will maintain the confidential nature of the arbitration proceeding and award, except as necessary to prepare for or conduct the arbitration, to seek a preliminary remedy from a court, to enforce or challenge an award, or as otherwise required by law.

If any part of this section is found invalid or unenforceable, the remainder will still be given full force and effect, except that if the class, collective, and representative action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must be brought in court and not in arbitration.

24. Miscellaneous

Waiver. Our failure to enforce any provision of these Terms of Use is not a waiver of our right to do so later.

Severability. If any provision of these Terms of Use is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Independent relationship. Nothing in these Terms of Use creates a partnership, joint venture, or agency relationship between you and the Company.

Taxes. We do not provide tax advice. You are solely responsible for any taxes arising from your use of the Platform or receipt of any prize.

Export compliance. Access to the Platform from outside the United States, and any related export-control compliance, is your responsibility; the Platform is intended for use within the United States only.

Continued use. We may amend our policies, including these Terms of Use, at any time. Where a change would materially limit your rights, we will notify you on your next visit and require you to reconfirm your acceptance before continuing to play. Your continued use of the Platform after a change takes effect constitutes acceptance of that change.

Entire agreement. These Terms of Use, together with our Sweepstakes Rules, Privacy Policy, and Legal Notices, constitute the entire agreement between you and the Company regarding the Platform, and supersede any prior understandings between you and the Company on that subject.

California notice. Under California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite N-112, Sacramento, CA 95834, or by phone at 1-800-952-5210.
